Terms of service
Draft for legal review. Effective date to be set at launch.
1. The service
TextManner, operated by DataHubz ("we", "us"), provides a platform for sending and receiving SMS messages to and from United States telephone numbers through a web dashboard and an API. You may use the service only for lawful business messaging to recipients who have given consent.
2. Accounts and workspaces
You must provide accurate business and contact details. Each workspace represents one business sending identity. Agencies may administer client workspaces through explicit grants and remain responsible for their clients' compliance. You are responsible for every message sent with your API keys.
3. Consent and compliance
You must obtain and keep records of prior express consent for every recipient, honour opt-out requests immediately, identify your business in marketing messages, and comply with the Telephone Consumer Protection Act, the CTIA Messaging Principles and Best Practices, carrier requirements and applicable state laws. Carrier registration (A2P 10DLC) is required before live sending. Approval decisions and timing belong to the carriers and registries, not to us.
4. Prohibited use
No messages that are unlawful, deceptive, harassing, or that involve content prohibited by carriers (including sex, hate, alcohol, firearms and tobacco content without the required age gating), phishing, malware, unsolicited bulk messaging, or messages to recipients who have not consented or who have opted out. See the Acceptable use policy.
5. Fees
Usage is billed per message segment plus pass-through carrier fees, number rental and registration fees, all shown before you send and itemized on your invoice. Fees change when providers and carriers change theirs. Spend caps you set are enforced; sending stops when a cap is reached.
6. Delivery
"Sent" means the carrier accepted the message. "Delivered" means a positive handset report. We never infer delivery. The service is provided without warranty of delivery, as carrier networks are outside our control.
7. Suspension and termination
We may suspend sending for suspected abuse, carrier complaints, unpaid fees or legal requirements, and will tell you why where the law allows. You may close your workspace at any time; records required by law or carriers are kept for the required period.
8. Liability
To the extent permitted by law, our liability is limited to the fees you paid in the three months before the claim. We are not liable for indirect or consequential damages.
9. Changes
We will announce material changes to these terms by email and on the dashboard at least 14 days before they take effect.
